How can we fight the "fierce fans"? What does an economic analysis of the law suggest in this regard? Enrique Ghersi invites you to examine the problem from three different viewpoints, each of which suggests a different road to combat or eradicate the violence in stadiums: (i) civil tort liability; (ii) criminal-administrative liability; and (iii) the right of property. In the opinion of the author, it is not unusual that the first two perspectives end up providing unsatisfactory answers since the source of the problem of violence in stadiums lies first of all in the lack of definition of the rights of property in the area of soccer. So, if the intent is to guarantee personal and patrimonial integrity of the public attending soccer games, legislation must be proposed that starts by reconstituting the rights of property in this sport, destroyed by the monopoly of the FIFA, in order for the incentives to be where they must be and the owners of the business to be the ones in charge of "taking care of it."
