In the opinion of the President of the organization Libertades Públicas, Juan Ignacio Correa, the institutional condition of freedom of expression and information in Chile is still disheartening. In the report reproduced here, he analyzes its evolution in 2003 in its constitutional, legal, and judicial aspects and in the competence of the National Television Council (CNTV). J.J. Correa points out, among other aspects, that even though the repeal of the Crime of Defamation Law approved by the Senate is an advance, the Chamber of Deputies, on the other hand, has reestablished this crime in the proposed bill for the Protection of Personal Honor and Privacy. In turn, he warns that incoherency persists between the constitutional recognition of rights (such as freedom of expression and information) and the extension of judicial actions for its control (particularly, the preventive remedy of protection). Finally, he also puts forward an adverse opinion regarding the punitive prerogatives of the National Television Council.
