The author of this article develops the ideas that served as grounds for the proposal on regulation of crimes against the environment prepared by the Technical Secretariat of the Criminal Commission Forum, which were almost all incorporated in the articles of the text of the Preliminary Criminal Code Project delivered to the President of the Republic on December 18, 2005. These proposed ideas and articles were prepared, in a preliminary version, in the framework of the Fondecyt Project 1010206-2001 on criminal treatment of crimes against the environment in Chile, and they have now also been included in a recent independent Bill of Law of Senators Ávila, Girardi, Flores and Ominami (Boletín No. 514-12), currently under discussion in the Senate.
