The author makes a critical examination of the regulation of crimes related to the environment contained in the Preliminary Criminal Code Project of the Ministry of Justice of 2005. First, he formulates general considerations related to the purpose of protection and the modes of attack on environmental crimes, related to the dependence of criminal law on administrative law in the configuration of those crimes. He then critically examines the rules on crimes in particular contemplated in the preliminary project, as well as the general rules on authorship, relevance of illegal administrative authorizations, and penalties for legal entities. The result of this examination, clearly negative for the preliminary project, is finally summarized in conclusion.
